1. Agreement to Terms

By downloading, installing, or using Wanderist (the "Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Application.

Wanderist is provided by Wanderist Inc. ("Company," "we," "us," "our").

2. Use License

2.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Wanderist Application for personal, non-commercial purposes in accordance with these Terms.

2.2 Restrictions

You agree NOT to:

• Modify, copy, or create derivatives of the Application
• Reverse-engineer or decompile the Application
• Use the Application for commercial purposes
• Interfere with or disrupt servers or networks
• Attempt to gain unauthorized access to any portion of the Application
• Use the Application to transmit malware, viruses, or harmful code
• Scrape, crawl, or automate data collection
• Use the Application in any manner that violates applicable laws

3. User Accounts & Registration

The Wanderist Application is designed to function without user accounts. All data is stored locally on your device.

No Account Liability: Because we do not maintain user accounts:

• We cannot recover lost or deleted data
• We are not responsible for data loss due to device damage or loss
• We recommend you export important data regularly
• We have no way to verify your identity for account recovery

4. Acceptable Use Policy

4.1 Community Content

You agree that any community contributions (insights, comments, events) you post will:

• Be Truthful: Not contain deliberately false or misleading information
• Be Legal: Not violate any laws or intellectual property rights
• Be Respectful: Not contain harassment, hate speech, or discrimination
• Be Appropriate: Not contain explicit sexual content, violence, or illegal activities
• Respect Privacy: Not include other people's personal information without consent

4.2 Prohibited Community Content

We will remove or flag community content that:

• Violates laws (scams, illegal activities)
• Contains hate speech, harassment, or discrimination
• Is sexually explicit or contains graphic violence
• Infringes on intellectual property rights
• Spreads misinformation about health, safety, or visas
• Contains other users' personal information
• Is spam or promotional content

5. Limitation of Liability

5.1 No Warranty

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Fitness for a particular purpose
• Merchantability
• Accuracy or completeness of information
• Non-infringement of rights

5.2 Community Content Liability

WANDERIST IS NOT RESPONSIBLE FOR:

• Accuracy: Community contributions may contain false or outdated information
• Safety: Following community advice may result in injury, loss, or damage
• Consequences: Any decisions or actions you take based on community content
• Legal Issues: Visa, tax, or immigration advice in community content
• Travel Safety: Conditions, risks, or incidents in any destination

You use community content at your own risk. Always verify critical information independently.

5.3 Limitation of Damages

IN NO EVENT SHALL WANDERIST BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Lost profits, lost data, or lost opportunities
• Any damages exceeding $100 or the app purchase price (if applicable)

6. Disclaimers Specific to Travel Data

6.1 Visa & Immigration

Community content about visa requirements, processes, or timelines:

• Is NOT legal advice
• May be outdated or inaccurate
• Varies by individual circumstances
• You must independently verify with official government sources

6.2 Health Information

Community health recommendations:

• Are NOT medical advice
• Should not replace professional medical consultation
• May be inaccurate or dangerous
• Consult qualified healthcare professionals for medical decisions

6.3 Safety Information

Community safety warnings or advice:

• Reflect individual experiences, not comprehensive data
• May be outdated or biased
• Do NOT constitute a complete safety assessment
• Conduct independent research and exercise your own judgment

6.4 Currency & Financial Data

• Currency conversions may not be real-time or accurate
• Budget calculations are estimates only
• Cost of living data may vary by source
• Do not rely solely on app data for financial planning

7. Travel & Safety Responsibility

7.1 You Are Responsible

When you travel, you are responsible for:

• Your own safety and well-being
• Understanding visa, entry, and legal requirements
• Obtaining necessary travel documents and insurance
• Researching destinations thoroughly
• Making informed decisions about where and when to travel
• Following local laws and customs

7.2 We Are Not Responsible

Wanderist is not responsible for:

• Travel safety or security
• Visa denials or immigration issues
• Health, accidents, or medical emergencies
• Political instability, natural disasters, or terrorism
• Theft, loss, or damage to your belongings
• Any consequences of your travel decisions

Travel Insurance Recommendation: We strongly recommend obtaining comprehensive travel insurance, including medical coverage, trip cancellation, theft/loss coverage, and emergency evacuation insurance.

8. Intellectual Property

The Wanderist Application, including its design, features, and code, is protected by copyright and other intellectual property laws.

• Your Content: You retain all rights to content you create (trip plans, notes, etc.)
• Community Content: You grant us a license to display community contributions to other users
• Removal Rights: We may remove your content at any time if it violates these Terms

9. Modifications to Terms

We may modify these Terms at any time. Material changes will be notified via:

• In-app notification
• Updated "Last Updated" date on this document

Your continued use of the Application constitutes acceptance of modified Terms.

10. Governing Law & Dispute Resolution

Any legal disputes arising from your use of the Application shall be:

• Subject to mandatory arbitration (not court litigation)
• Conducted in English
• Limited to individual disputes (no class actions)
